Baltic TCG — Terms & Conditions

Important: This document has been drafted as a starting point based on general UK consumer law (Consumer Rights Act 2015, Consumer Contracts Regulations 2013). It is not a substitute for legal advice. Please have this reviewed by a solicitor before publishing it on your website.
1. Who we are
Baltic TCG Ltd (Company No. 16626658) trading as "Baltic TCG," 70 Stanhope Street, Liverpool, L8 5RF ("we," "us," "our"). These Terms & Conditions apply to all purchases, sales, bookings, and events at our store and through our website (balticTCG.co.uk).
By visiting our store, using our website, booking an appointment, or attending an event, you agree to these terms.
2. Buying from us (in-store and online)
2.1 Product descriptions
We do our best to accurately describe and grade all products, including condition of singles, sealed status of products, and authenticity of graded items. Images are for illustrative purposes — the exact card/item you receive may vary slightly in appearance (e.g. minor print line differences) unless purchasing a specific, pictured item.
2.2 Sealed product
Once a sealed product (booster pack, box, ETB, tin, etc.) is opened, we cannot accept returns or exchanges based on pull rates or the specific contents found inside. Contents of sealed product are randomised by the manufacturer and are not something we can control or be held responsible for.
2.3 Faulty or defective goods
If a sealed product has a genuine manufacturing fault (for example, a damaged box, a missing or miscut card from the manufacturer, or a defective seal preventing normal opening), you are entitled to a repair, replacement, or refund under the Consumer Rights Act 2015. This does not cover normal variation in pull rates or contents.
2.4 Singles and condition
Cards are graded by us using standard industry terms (Near Mint, Lightly Played, Moderately Played, Heavily Played, Damaged). Condition is assessed and agreed at the point of sale. Once a card has left the store, we cannot accept condition disputes unless the card was misdescribed at the time of sale.
2.5 Graded cards (PSA, CGC, BGS, etc.)
We are not the grading company. Any dispute about a grade, authentication, or slab condition must be taken up with the relevant grading company directly. We are not responsible for grading company errors, delays, or grade changes after sale.
2.6 Change of mind
We are not legally required to offer refunds or exchanges simply because you've changed your mind about an in-store purchase. We may offer a goodwill exchange or store credit at our discretion, but this is not a guaranteed right.
2.7 Online orders (if applicable)
If you purchase from our website for delivery, you have a legal right to cancel your order within 14 days of receipt under the Consumer Contracts Regulations 2013, except where the item is a sealed product you have opened (this exception applies because the value of opened sealed product cannot be reasonably assessed once unsealed, similar to other sealed audio/video/software products). To cancel, contact us at info@baltictcg.co.uk within the 14-day period.
3. Selling to us (buylist / trade-ins)
3.1 We reserve the right to refuse
We may decline to purchase any card, sealed product, or collection, in whole or in part, at our sole discretion. This includes (but is not limited to) items we suspect to be counterfeit, altered, stolen, or outside what we are currently buying.
3.2 Estimates are not offers
Any price estimate given online, by booking form, by phone, or by message is indicative only and is not a binding offer. Your final price will be confirmed in person, after we have physically inspected your cards or sealed product against current market data (e.g. live UK sold listings).
3.3 Ownership and right to sell
By offering items to us for sale, you confirm that you are the legal owner of those items and have the right to sell them. If we later discover an item sold to us was stolen, counterfeit, or otherwise not lawfully yours to sell, we reserve the right to void the transaction and reclaim any payment made, and may report the matter to the relevant authorities.
3.4 Authenticity
We reserve the right to decline or reverse a purchase if we determine, at any point, that an item is counterfeit or has been altered (e.g. recoloured, trimmed, resealed).
3.5 Payment
Payment will be made via the method agreed at the time of sale (cash or store credit, at the percentage rates communicated to you in advance). Payment is made once we have completed inspection and you have accepted our final offer.
3.6 Booking appointments
Booking a "Sell Your Cards" appointment online reserves a time slot for you to bring items in. It does not commit us to purchasing any specific item, nor does it commit you to selling. Slots are allocated on a first-come, first-served basis and are not guaranteed until you receive a confirmation email.
4. Events (Prerelease, Trade Day, Auction, Vendor Takeover, League Nights, etc.)
4.1 Entry and tickets
Where an event requires a paid ticket or entry fee, that fee is non-refundable except where the event is cancelled or rescheduled by us.
4.2 Conduct
We reserve the right to refuse entry to, or remove from the premises, anyone behaving in a way that is disruptive, abusive, or unsafe to staff or other attendees, without refund.
4.3 Sanctioned play (Pokémon TCG, etc.)
Sanctioned tournaments are run in accordance with the relevant organisation's official rules (e.g. Play! Pokémon). Disputes about official rulings, deck legality, or tournament results are handled under those rules, not under these Terms.
4.4 Liability at events
We are not responsible for loss, theft, or damage to personal property (including cards, binders, or devices) brought to our store or events, except where caused by our negligence.
5. Liability
5.1 General
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud.
5.2 Limitation
Subject to clause 5.1, our liability to you for any single claim arising from a purchase or sale is limited to the value of that transaction.
5.3 Collections and consequential loss
We are not liable for any loss of value, investment loss, or consequential loss arising from the rise or fall in market value of trading cards or sealed product, whether bought from or sold to us.
6. Intellectual property
Pokémon, One Piece, Lorcana, and other trading card game names, logos, and imagery referenced on our site and in our store are trademarks of their respective owners. Baltic TCG is an independent retailer and is not affiliated with, sponsored by, or endorsed by these companies.
7. Changes to these Terms
We may update these Terms from time to time. The version published on our website at the time of your purchase, sale, or booking applies to that transaction.
8. Governing law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
